A. Entire Agreement
This Charter Contract together with the Company’s Jet Membership & on demand terms and conditions, the Aircraft Operators terms and conditions and the Company’s privacy policy together form the entire agreement between the Company and the Client.

1.These Terms
1 We are primarily a private aviation broker and act as an intermediary between you and our network of aircraft operators (Aircraft Operator) in order to charter private jet travel on your behalf (the Services). In addition to private aviation services we also source and supply further Lifestyle Services, details of which are set out at clause 10 of these terms and conditions.
2 Please read these terms carefully before you make any bookings with us. These terms tell you who we are, how we will provide the Services to you, how you and we may change or end the contract, what to do if there is a problem and other important information. These terms will be incorporated into each booking you make with us (Charter Contract).
3 In some areas you will have different rights under these terms depending on whether you are a business or a consumer. You are a consumer if:
You are an individual; and
You are buying Services from us wholly or mainly for your perusal use (not for use in connection
with your trade, business, craft or profession)
4 If you are a business customer, you acknowledge that you have not relied on any statement,
promise, representation, assurance or warranty made or given by or on behalf of us which is not set out in these terms and that you shall have no claim for innocent or negligent misrepresentation or negligent misrepresentation based on any statement in this agreement.
5 These terms and conditions in conjunction with an aircraft operators terms and conditions
constitutes the entire terms and conditions under which we will supply Services to you.
2. Information About Us and How to Contact Us
2.1 We are Atlas Jet Limited, a company registered , a company incorporated in England and
Wales with company number 12985151 with its registered address at International House, 6
South Molton Street, London, England, W1K 5QF (Atlas Jet/we/us/our);
2.2 You can contact us by telephoning us at +44 2045197785 or by writing to us at
ops@atlasjetcharter.com. If we have to contact you we will do so by telephone or by writing
to you at the email address or postal address you provided to us in the Charter Contract.
When we use the words “writing” or “written” in these terms, this includes emails.
2.3 Atlas Jet Limited is an air charter broker and acts as an agent between its clients and
third-party Aircraft Operators. You agree to appoint Atlas Jet to be your agent for the purposes of booking the Services. You accept that Atlas Jet has no direct or indirect responsibility or liability in connection with the performance and services by any third-party Aircraft Operator. 2.4 All client money is FSCS protected and held with, Flagstone Group Ltd, a company incorporated in England and Wales with company number 08528880 with its registered address at 1st Floor, Clareville House 27, Oxendon Street, London, England, SW1Y 4EL. Flagstone Group Ltd is authorised by the Financial Conduct Authority (Reference Number 605504) under the Payment Service Regulations 2017 for the provision of payment services. We do not hold any client money.
3. Our Services
3.1 We provide our Services on a membership subscription basis (Jet Membership Card)
& on an ad hoc or individual charter basis in response to specific requests from the Client.
3.2 By subscribing to our Jet Membership Card you will have complete control over the
scheduling and usage of membership card benefits along with capped hourly rates and
all-inclusive packages.
3.3 Our Jet Membership Card offers the following three types of memberships:
i. Turboprop Membership;
ii. Light Card Membership; and
iii. Everything Membership.
3.4 Turboprop Membership: Designed for clients requiring our turboprop jet which is designed
for 6-8 passengers, the turboprop aircraft is driven by propeller-led turbine engines. Slower
than conventional jets and ideal for short regional flights, it is an economical option offering
the same level of comfort and luxury found on larger business jets.
3.5 Light Card Membership: Designed for clients requiring a light to superlight jet for very short
distances ranging from 2 hours to a maximum of 4 hours in flight time. Our very light jets
deliver up to two hour flight times, light jets deliver up to three hour flight times and
super-light jets deliver up to four hours of flight time.
3.6 Everything Membership: Designed for clients requiring turboprop, light, midsize or heavy
jets. Our midsize to ultra-long range jets are for long haul flights ranging from 5 hours to 9
hours and more. Our midsize jets deliver up to five hours flight times, super-midsize jets
deliver up to eight hours flight time, heavy jets and ultra-long range jets deliver from 3 to 9
hours and more.
3.7 As a Client of Atlas Jet you must provide the following information for each passenger:
i. Full name (as per passport), nationality, gender, date and place of birth;
ii. Passport number, country of issue and expiry date; and
iii. Any pre-existing medical conditions and fitness to travel. You accept sole
responsibility for having adequate travel insurance, all necessary personal or
travel documents (including passports, visas and other required certificates).
3.8 If you require any changes to your flight, time, itinerary, number of passengers or type of
aircraft, you may be liable to pay additional charges for any such changes.
3.9 We shall arrange flights on your behalf and you authorise us to do so. You agree that the
Aircraft Operator will have sole responsibility for operation of the flight schedule,
maintenance, insurance and operation of the aircraft. The Aircraft Operator will be
responsible for ensuring that the flight is properly manned and equipped, fuelled and
airworthy in accordance with all applicable laws and regulations for the purposes of your
flight. The Aircraft Operator shall ensure that the aircraft is operated in accordance with all
applicable laws and regulations during the period of the flight.
3.10 If at any time before your scheduled flight, the aircraft we have booked for you becomes
unavailable or unserviceable for any reason, we will use commercially reasonable endeavours
to find another suitable aircraft at the same price. If we are able to source a replacement
aircraft but there is an increased price for such flight, you will need to pay us the balance
before we confirm the new flight. If we are unable to find a suitable aircraft, we shall return
the Charter Price and shall have no further liability to you whatsoever.
3.11 We will use our reasonable endeavours to inform you as soon as reasonably practicable on
becoming aware of a possible delay or cancellation for any reason to a scheduled flight. In the
interests of safety, the captain of the relevant Aircraft Operator’s flight shall have full
discretion concerning the preparation of the aircraft and the flight route.
3.12 We make no representation or warranty about the Aircraft Operator and will not be liable in
any way whatsoever for any loss, damage, injury or expense suffered or incurred by you or
any third party howsoever caused in respect of the aircraft we book on your behalf.
3.14 We shall procure that the Aircraft Operator shall supply you with all travel documents and
other necessary documents relating to the carriage undertaken by you pursuant to this
agreement, and provide all necessary information and assistance to complete such documents
as soon as possible following the date of entry into this agreement.
3.15 All flights are conditional on the grant and retention of the Aircraft Operator’s relevant air
transport licence, as required under the laws of regulations of the state in which the aircraft is
registered or, from or over which, the aircraft will be flown.
3.16 You shall ensure that all passengers and their luggage shall be at the specified check-in point at the departure airport no later than 30 minutes (or as otherwise advised for the particular
flight) before the scheduled flight time and that all passengers possess the required travel
documents, identity documents, passports, visas and other documents required by the Aircraft
Operator and authorities of the jurisdiction of departure. We are not responsible for the costs
or arrangements of any visas for the purposes of your flight.
3.17 In the event of a passenger’s misconduct, or where their health is deemed by the captain of the Aircraft Operator to be a matter of concern, the captain shall be entitled to take any action
deemed necessary to procure the safety of the flight.
3.18 All aircrafts are non-smoking, unless confirmed by us in writing prior to the flight.
3.19 Where WiFi is available, unless agreed in advance of your flight, WiFi charges will not be
included in the price charged for our Services. These will be invoiced to you after the flight.
4 Membership Account and Deposit
4.1 You shall pay an initial minimum deposit (“Initial Deposit”) into your Membership account
on a credit basis, based on the hours requested in accordance with the table below: Hours

We reserve the right to increase the hourly capped rate, if for any reason there is an increase
in the live market charges between your booking date and the date of the flight.
4.2 All amounts deposited by you shall be maintained in a designated member account
(Membership Account) set up by us solely for you. We will have the sole right to withdraw
funds from, and otherwise effect transactions from the Membership Account. At any time,
subject to the provisions hereof, you may make additional deposits into your Membership
Account to be used towards the Services or Lifestyle Services.
4.3 You shall at all times ensure your Membership Account is credited for the full price of the
requested journey including expenses and additional costs in advance of the time of your
flight. You may credit your Membership Account by purchasing hours in accordance with the
capped rates set out in clause 4.1 above.
4.4 In the event your Membership Account is not credited for the full price of the requested
journey, we may use up to 50% of the Initial Deposit towards your use of our Services from
time to time.
4.5 If you utilise all the credit in your Membership Account and 50% of the Initial Deposit, we
will cease to provide our Services until the Membership Account is credited for the full price
(where applicable, the outstanding difference in price) of the requested journey.
4.6 We accept payments in pound sterling (£), Euro (€) and US dollar ($) only. All exchange
rates and bank charges will be borne by you.
5 Price and Payment
5 .1 The Charter Price (which includes relevant taxes if applicable) will be the price as explained to you over the telephone or in the course of email exchanges. The Charter Price is based on the Aircraft Operators live market charges and aviation fuel costs calculated at the booking date. The prices set out will include all reasonable expenses associated with the flight including but not limited to fuel surcharges, landing charges, damages charges, customs fees and out-of-pocket expenses. We reserve the right to increase the Charter Price, if for any reason there is an increase in the cost of aviation fuel between your booking date and the date of the flight. As we act as a charter booking service, we will deduct from the Charter Price our fees for the Services before transferring funds to the relevant Aircraft Operator on your behalf.
5.2 For the avoidance of doubt, a flight subject to an empty leg conditions, constitutes an [Empty Leg / One Way] Flight. In consideration for reduced rates, it may be canceled by (Aircraft Operator) at any time prior to scheduled departure time at its sole discretion. If (Aircraft Operator) elects to do so, it will promptly refund the client subject to the relevant sections of the terms and conditions.
5.3 If taxes are applicable and the rates of those taxes changes between your order date and the date we supply the Services, we will adjust the rate of tax that you pay, unless you have already paid for the Services in full before the change in the rate of tax takes effect.
54 If you are a business customer you must pay all amounts due to us under these terms in full without any set-off, counterclaim, deduction or withholding (other than any deduction or withholding of tax as required by law).
5.5 Our fixed hourly rates for all Jet Card members will be available upon request.
6 Termination
6.1 You can terminate the membership immediately, by giving us a notice of termination in writing.
6.2 If you terminate the membership within 14 days of signing up, you will be refunded the amount outstanding in your Membership Account less any bank set up fees and administrative charges.
6 .3 If you terminate the membership within 6 months of signing up, you will refunded the amount outstanding in your Membership Account less a 5% cancellation fee will apply to cover any administrative charges, account setup and any banking fees incurred.
6 .4 On termination of the membership all refunds may take up to 10 business days to be transferred into the outgoing member’s account. Such account details to be provided by the member to us in writing within the termination notice.
7 Flight Requests
7 All flight requests must be submitted to us by giving minimum 72 hours’ notice to us, prior to
requested departure and must include the following details:
i. Departure date and time
ii. Return date and time
iii. Departure city and airport
iv. Destination city and airport
v. Passenger count
vi. Number of pets (if any)
vii. Specific luggage requirements
viii. Lifestyle Services required
ix. Payment currency
7 All flight requests submitted to us inside the 72 hors’ notice period will be subject to the Aircraft Operators live market rate (this could be more than the capped rate).
8 Operation Zones
8.1 Primary Service Areas for the ‘Turboprop and Light Card’ Members:
Includes EEA Countries (Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic,
Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Ireland, Italy, Latvia,
Liechtenstein, Lithuania, Luxembourg, Malta, Netherlands, Norway, Poland, Portugal,
Romania, Slovakia, Slovenia, Spain, Sweden, UK), plus Switzerland, Turkey and Norway. UK
& EU domestic flights are excluded.
UNITED STATES REGION: The 49 States of the United States of America (excluding
Alaska), Hawaii (flights within the State of Hawaii are subject to availability), Mexico and the
Caribbean Islands (flights between the Caribbean Islands are subject to availability).
Primary Service Areas for the ‘Everything Card’ Members:
8.2 EUROPEAN REGION:
Albania, Austria, Belgium, Bulgaria, Bosnia & Herzegovina, Croatia, Czech Republic,
Cyprus, Denmark, Estonia – Tallinn only, Finland, France, Germany, Greece, Hungary, Israel,
Italy, Latvia – Riga only, Lithuania – Vilnius only, Luxembourg, Ireland, Macedonia, Malta,
Montenegro, Netherlands, Morocco – Casablanca and Marrakesh only, Norway, Poland,
Portugal, Romania, Russia – Kaliningrad, St. Petersburg and Moscow only (but not flights
between the cities due to local restrictions), Serbia, Slovakia, Slovenia, Spain, Sweden,
Switzerland, Ukraine – Kiev only and the United Kingdom. Flights to and from the overseas
territories of any country within the European Region (for example The Azores) are subject to
availability.
MIDDLE EAST REGION:
Armenia, Azerbaijan, Bahrain, Egypt, Georgia, Iran, Jordan, Kuwait, Lebanon, the Maldives,
Oman, Qatar, Saudi Arabia, Syria, Turkey, United Arab Emirates and Yemen.
ASIA PACIFIC REGION:
Brunei, Cambodia, China, Hong Kong SAR, India – Delhi, Mumbai and Bangalore only,
Indonesia, Japan, Laos, Macau SAR, Malaysia, Myanmar, North Korea, Philippines,
Singapore, South Korea, Taiwan, Thailand and Vietnam.
UNITED STATES REGION:
The 49 States of the United States of America (excluding Alaska), Hawaii (flights within
the State of Hawaii are subject to availability), Mexico and the Caribbean Islands (flights
between the Caribbean Islands are subject to availability).
9 Cancellation
9.1 We mirror the cancellation policy of the relevant Aircraft Operators cancellation policy for
each flight confirmed, the details of the current cancellation terms are provided in the flight
confirmation for each flight and are subject to change.
9.2 If you wish to cancel any flight after entering into a Charter Contract, the following rates
will be representative of a standard operator cancellation policy as listed below:
100% of the charter Price, if cancelled less than 24 hours prior to the
scheduled departure time.
10% of the Charter Price if cancelled after confirmation of the journey;
50% of the Charter Price if cancelled less than 72 hours prior to the
scheduled departure time; and
75% of the Charter Price if cancelled less than 48 hours prior to the
scheduled departure time.
100% of the charter Price, if cancelled less than 24 hours prior to the
scheduled departure time.
10 Lifestyle Services
In addition to the Services, we offer assistance with booking ground transportation services
which includes ground transportation to and from the airport. We also assist with helicopter
rentals, hotel bookings, and experiences (Lifestyle Services). Price list for such Lifestyle
Services will be provided upon request. All amounts for the Lifestyle Services will be
deducted from the Membership Account balance.
11 Dangerous goods and security items
11.1 Dangerous goods are articles or substances which are capable of posing a risk to health, safety, property or the environment and are listed and classified in the International Civil Aviation
Regulations. Dangerous Goods can only be carried according to the International Civil
Aviation Organisation’s Regulations for the Safe Transport of Dangerous Goods by Air
(Technical Instructions), irrespective of whether the flight is wholly or partly within or wholly
outside the territory of a State. An approval or exemption may be required to permit the
transport of some dangerous goods. Each passenger is personally responsible for not carrying
the following articles into the security restricted area or into the cabin of an aircraft:
i. Guns, Firearms and Weapons; any object capable or appearing capable, of
discharging a projectile or causing injury, including all firearms (pistols, revolvers,
rifles, shotguns, etc.) replica and imitation firearms, component parts of firearms
(excluding telescopic sighting devices &sights), air pistols, rifles and pellet guns.
Signal flare pistols, Starter pistols, Toy guns of all types, compressed air and CO2
guns such as pistols, pellet guns, rifles, ball bearing guns, industrial bolt and nail
guns, cross bows, catapults, harpoon and spear guns, Animal humane killers, stun or
shocking devices, e.g. stun guns, tasers, stun batons, cattle prods, ballistic conducted
energy weapons (laser), lighters shaped like a firearm;
ii. Pointed/edged Weapons &Sharp Objects; pointed or bladed articles capable of
causing injury, including axes &hatchets, cleavers, arrows and darts, crampons
(grappling iron, hooked bar of iron, or plate with iron spikes used in mountaineering),
harpoons & spears, ice axes &ice picks, ice skates, knives with blades of more than 6
cms including lockable or flick knives, ceremonial, religious and hunting knives,
made of metal or any other material strong enough to be used as a potential weapon,
meat cleavers, machetes, open razors and blades (excluding safety or disposable
razors with blades enclosed in cartridge), sabres, swords and swordsticks, scalpels,
scissors with blades more than 6 cms as measured from the fulcrum, ski and
walking/hiking poles, throwing stars, tradesman’s tools with a blade or a shaft of more
than 6 cms that have the potential to be used as a pointed or edged weapon, e.g. drills
and drill bits, box cutters, utility knives, all saws, screwdrivers, chisels, crowbars,
hammers, pliers, wrenches/spanners, blow torches;
iii. Blunt Instruments; any blunt instrument capable of causing injury, including tennis
rackets, baseball and softball bats, clubs or batons — rigid or flexible — e.g. billy
clubs, blackjacks (truncheon of leather covered lead with flexible shaft), night sticks
&batons, cricket bats, golf clubs, hockey and hurling sticks, lacrosse sticks, kayak
and canoe paddles, skateboards, billiard, snooker and pool cues, fishing rods, martial
arts equipment, e.g. knuckle dusters, clubs, coshes, rice flails, num-chucks;
iv. Explosives and flammable substances; any explosive or highly combustible substance
which poses a risk to the health of passengers and crew or the security/safety of
aircraft or property, including ammunition, blasting caps, detonators &fuses,
explosives and explosive devices, replica or imitation explosive material or devices,
mines &other explosive military store, grenades of all types. gas &gas containers, e.g.
butane, propane, acetylene, oxygen — in large volume, fireworks, flares in any form
and other pyrotechnics (including party poppers and toy caps), non-safety matches,
smoke generating canisters or cartridges, flammable liquid fuel, e.g. petrol/gasoline,
diesel, lighter fluid, alcohol, ethanol, aerosol spray paint, turpentine &paint thinner,
alcoholic beverages exceeding 70% by volume (140% proof);
v. Chemical and Toxic Substances: any chemical or toxic substances which pose a risk
to the health of passengers and crew or the security/ safety of aircraft or property,
including: acids and alkalis, e.g. spillable “wet” batteries, corrosive or bleaching
substances — e.g. mercury, chlorine, disabling or incapacitating chemical, gases and
sprays — e.g. mace, pepper spray, capsicum, tear gas, acid sprays, animal repellent
sprays, radioactive material — e.g. medicinal or commercial isotopes, poisons,
infectious or biological hazardous material — e.g. infected blood, bacteria and
viruses, material capable of spontaneous ignition or combustion, fire extinguishers
(excepting as authorised by fire protocols and as aircraft emergency equipment);
vi. The following items shall not be placed in Checked Baggage: Dynamite, gunpowder,
explosives, including detonators, fuses, ammunition, grenades, mines blasting caps
and plastic explosives. Gases, including propane and butane. Flammable liquids,
including gasoline, methanol, flammable solids and reactive substances, including
magnesium, firelighters, fireworks, flares and other pyrotechnics. Oxidisers and
organic peroxides, including bleach, car body repair kits. Toxic or infectious
substances, including rat poison, infected blood, radioactive material, including
medicinal or commercial isotopes. Corrosives, including mercury, vehicle batteries,
and vehicle fuel system components which have contained fuel.
vii. Atlas Jet shall be contacted directly for any queries or approvals required for carriage
of dangerous goods or security items.
12 Exclusion of Liability/Indemnity
1 Atlas Jet shall maintain a non-owned aircraft liability insurance policy covered under a combined single limit for a maximum of amount GBP 1,000,000.
2 Atlas Jet shall not have nor assume any responsibility or liability for activities performed by any
Aircraft Operator. The Aircraft Operator shall be solely responsible for all claims arising out of any and all occurrences, accidents or incidents that occur on or in connection with the aircraft operated by the Aircraft Operator, including without limitation all personal injuries, property damage or wrongful death.
3 Atlas Jet shall not be responsible for any negligent act or omission by an Aircraft Operator or its personnel.
4 Atlas Jet will not be liable for any failure or delay in performing any of its obligations under these terms caused by any of the following causes: weather (including adverse weather conditions preventing any services, inspections or flights of the aircraft), work stoppages, strikes, acts of ware or terrorism, acts of God of the public enemy, civil war, insurrection or riots, fires, floods, explosions, earthquakes, serious accidents, epidemics, quarantine restrictions, acts of government (including government shut-downs), labour disputes causing cessation, slowdown or interruption of work, suppliers, parts or materials, or any other cause not within the direct control of us.
5 You shall indemnify us against all liabilities, expenses and claims (including legal fees) in respectof any liability of the carrier to third parties (including but not limited to passengers) for any loss or damage whatsoever (including expenses and costs on a full indemnity basis) arising out of any act or omission of the Aircraft Operators its personnel, agents or any passenger carried by your authority.
6 Neither Party hereto shall in any case be responsible to the other for indirect, consequential or
punitive damages as a result of any action or inaction in connection with these terms. In addition,
the client agrees that in all cases to which such insurance applies the protection thereunder and
proceeds thereof to which the client is entitled shall be the client’s sole recourse against Atlas Jet and its affiliates, officers, employees and agents or an damages, including, without limitation,
damages for loss of use or loss of profits and/or any other damages claimed by the client or any
guest of the client, except to the extent caused by or due to the gross negligence or wilful
misconduct of Atlas Jet, its affiliates or its employees.
7 Due to current global geopolitical circumstances, flights to, from, or over countries involved in
active armed conflicts are unavailable. Additionally, any requested routes requiring deviation
around or overflying conflict zones will be subject to real-time pricing to account for necessary
diversions and associated operational considerations.
13 Applicable Law and Jurisdiction
The entire agreement shall be governed by and constructed in accordance with English Law
and the course of England and Wales shall have non-exclusive jurisdiction to deal with any
dispute arising hereunder.
